Pursuant to Chapter 240, Section 36(A)(7) of the Village Code, the Harbor and
Coastal Zone Management Commission is empowered “To recommend updates
the Local Waterfront Revitalization Program and its harbor management
elements.”
Accordingly, the Harbor and Coastal Zone Management Commission may provide a
recommendation to the Village Board of Trustees regarding the amendment of the
Village’s Local Waterfront Revitalization Plan (LWRP).

Pursuant to Chapter 240, Section 36(A)(7) of the Village Code, the Harbor and
Coastal Zone Management Commission is empowered “To recommend updates
the Local Waterfront Revitalization Program and its harbor management
elements.”
Accordingly, the Harbor and Coastal Zone Management Commission may provide a
recommendation to the Village Board of Trustees regarding the amendment of the

consistency determination, the Board of Trustees shall request written
recommendation regarding consistency from the Harbor and Coastal Zone
Management Commission and provide the Commission with a copy of the CAF and
the relevant materials supporting the action.”

Accordingly, the Harbor and Coastal Zone Management Commission may provide a
recommendation to the Village Board of Trustees regarding the determination of
consistency. The Village must respond to the NYS Department of State's Division
of Coastal Resources no later than December 19, 2020.
F. Proposed New York State Department of State’s Office of Planning,
Development and Community Infrastructure Consistency Determination
Recommendation Regarding 1110 Franklin Avenue and 729 East Prospect
Avenue Community Development Block Grant Project
Pursuant to Chapter 240, Section 36(A)(5) of the Village Code, the Harbor and
Coastal Zone Management Commission is empowered “To review proposed actions that may affect the coastal zone in order to determine their consistency with the
Village of Mamaroneck Local Waterfront Revitalization Program provided for in
Chapter 240, Section 29.” Also, “The Harbor and Coastal Zone Management
Commission shall diligently pursue the implementation of New York State coastal
zone legislation, maintaining close communication and dialogue with responsible state
and county agencies and legislators” in accordance with Chapter 240, Section 36(D)
of the Village Code.

Accordingly, the New York State Department of State’s Office of Planning,
Development and Community Infrastructure seeks a recommendation regarding its
determination of consistency for proposed “actions” occurring at 1110 Franklin
Avenue and 729 East Prospect Avenue. The Harbor and Coastal Zone Management
may provide a recommendation. The Harbor and Coastal Zone Management
Commission must respond to the NYS Department of State's Office of Planning,
Development and Community Infrastructure no later than December 30, 2020, if
electing to provide a recommendation.
